Most guidance on data subject requests assumes the requester is a consumer. But employees are data subjects too, and under laws like GDPR they can file an access request for the personal data their employer holds. Employee DSARs are often harder than consumer ones, because the data is more sensitive, more scattered, and more likely to involve other people.
Why Employee Requests Are Harder
- The data is broad and sensitive. Personnel files, performance reviews, payroll, emails, and messages can all contain the employee's personal data. The scope is wider than a typical consumer profile.
- Other people are entangled. Manager notes, peer feedback, and investigation records often mention colleagues. You have to disclose the requester's data without exposing third parties.
- Timing is rarely neutral. Employee access requests frequently arrive around a dispute, a departure, or a grievance, which raises the stakes on getting the response right.
What Tends to Be Exempt or Redacted
- References and confidential evaluations may be exempt or subject to redaction, depending on the jurisdiction.
- Ongoing investigations can justify withholding certain data while the process is live.
- Third-party personal data in the same documents is redacted, not disclosed.
